Terms of Service
Pivotal Web wants all its customers to have the best possible experience with us. We have a few policies that will allow that to happen.
Account Sign ups and Billing - Shared and Dedicated Hosting
All billing is done through Authorize.net CC PayPal, AlertPay and 2Checkout. We accept bank transfers and credit cards through their service. We will not setup any hosting account until the payment has been verified and confirmed. Before any order is setup, a Account Manager will review your order to confirm your information. Your billing cycle starts the day the payment has been made. You will receive an invoice at least 7 days before your payment is due.
Refund Policy
If client is not satisfied with services provided by Pivotal Web, client may be entitled to a refund after 45 days under normal circumstances. When you sign up with Pivotal Web you agree on this.. Dedicated Servers will NOT get a refund, client agree's to pay the invoice for the dedicated server on renewal day. Or will resolve in termination. Clients can contact customer service to work out a due date extention. Please note you will have to justify why you are making this request. We do NOT have to accept this.
Virtual Private Servers
All virtual private servers are not required an initial setup fee however all vps promotional offers are subject to a 3 month minimum contract.
All managed vps accounts are fully managed by Pivotal Web's staff any unmanaged vps accounts are solely the responsibility of the client. We do not allow illegal content on vps accounts but clients may host adult content so as long as it is fully copyrighted material that belongs to the client.
Software and Web Design Agreement
All terms for custom software and web design work is setup on a per contract basis. Each custom development will be bound by its own contract terms setup by the project manager and the client.
Pivotal Web Provided Software
All free software provided on Pivotal Web is on an as-is basis. We take no responsibility for how you use our software. We do require that all software downloaded from our site that is provided for free will not be redistributed in any way other than from Pivotal Web directly. You are free to modify the software as you need but all required links and credits must remain in tact.
Hosting Acceptable Use
All shared hosting accounts must follow our policy's. We reserve the right to disable, delete, or suspend any files or accounts on our servers that open security holes, use up above normal resources, or abuse server resources. No copyrighted works such as MP3s or Movies or torrent files may be hosted on the servers unless you own exclusive rights to own and distribute it. Server accounts may not be used specifically for file sharing or file hosting. Servers that exceed bandwidth or storage limits may be suspended without notice. Accounts that reach the max allotted bandwidth and file storage for three (3) consecutive months may be required to upgrade their plans. All dedicated or VPS hosting accounts may not run any IRC related service such as bots or servers. We do allow legal adult content. Bandwidth is measured per month. Servers that exceed the bandwidth requirements will be suspend for the remainder of the month.
Domains
Pivotal Web allows its customers to run multiple domains. You are required to manage your own settings which will require you to change the name servers to the one provided with your account for hosting. We currently can register domains directly for you for a nominal fee.
Pivotal Web.com reserves the right to modify or change this agreement at any time. We reserve the right to suspend, disable, or remove any account that violates any part of this agreement or that provides a poor image of Pivotal Web.
